In order to provide a high class, professional service, I have set up a few guidelines for users of my service. Some of these guideliness may seem strict, but they ensure a safe, functional, and trusted environment for my customers to publish their information on the Web. Many of my competitors do not require their customers to comply with these guidelines. If any of our potential customers are unwilling or unable to comply with these guidelines, we respectfully invite them to visit one of my competitors.

Personal accounts (basic hosting accounts provided by The WebHelper) are to be used by the primary owner only, account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.


I do not allow any of the following content to be published on a The WebHelper System:

- Illegal Material - This includes copyrighted works, commercial audio, video, or music files and any material in violation of any Federal, State or Local regulation.

- Adult Material - Includes all pornography, erotic images, or otherwise offensive, lewd or obscene content. The designation of "adult material" is left entirely to the discretion of The WebHelper.

- Warez - Includes pirated software, ROMS, emulators, freaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

- Mass Multimedia File Download Site - Includes the archiving and making available of large quantities of Multimedia files such as (but not limited to) MP3 or Real Media files for public downloading. The use of an occassional multimedia file for the enhancement of a web site is permitted. The designation of "Media File Download Site" is left entirely to the discretion of The WebHelper. Exception: If you will be selling mulitmedia products please let us know before getting an account with us. In general this is an exception to the above policy and will be handled on a case by case basis.

- Gambling related sites .

- Hate sites or content that could be reasonably considered as slanderous or libellous content that is questionable regarding any of the above criteria will be decided upon by a The WebHelper representative.

Users posting any of the above content on their sites will have their Web and/or incoming anonymous FTP services temporarily suspended. They will then be contacted by The WebHelpers and given the opportunity to remove the content in question before having their services reinstated. A repeated offense may cause cancellation of service without refund of any fees.


The WebHelper has a zero tolerance policy for SPAM E-Mail (also known as junk email)! I do not allow unsolicited email messages sent by users of my system. Users sending unsolicited email messages from my system, or messages from other systems that refers to their domain on my system, or posting SPAM in Usenet Newgroups will have all of their services canceled without refund of any fees. Resellers who have a client account who uses my systems for spamming shall have their client accounts terminated without reinstatement.


Customers caught using my system for illegal activities, including but not limited to breaking in to remote systems, credit card fraud, theft, vandalism, threats, or violence, will have their accounts immediately cancelled without refund of any fees.


The WebHelper's reserves the right to refuse service to anyone for any reason. I enforce this policy to ensure a professional environment for the users of my system.


High bandwidth usage: The WebHelper offers an unlimited use policy for my Reseller Servers by maintaining very large ratios of bandwidth per customer. In rare cases, The WebHelper may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, The WebHelper reserves the right to impose the High Resource User Policy for the consideration of all customers. This High bandwidth policy is superceded and does not apply to individual hosting plans. Individual hosting plans specify a fixed bandwith limit.

Some of my customers may be hosted on resold 3rd party servers which typically have fixed bandwidth limitations. Typically these limitations are 5GB per month. If you are approaching these limitations (consult your control panel for your current useage) you may request additional bandwidth for a small monthly fee. Please note that if your site exceeds it's bandwidth allocation your sever will cease delivering content until either your bandwdth limit is raised or a new month begins.

You can run any CGI and non-CGI scripts you desire, however I reserve the right to disable any script that dramatically affects server performance.

I currently do not allow IRC or IRC bots to be operated on my servers.

Due to excessive spammer abuse, I currently do not allow shareware or open source email/formmail programs to be operated on my servers. If you require the use of a form to mail program I suggest you use a 3rd party form mail service such as Matt Wright's formmail.com

I am proud to offer my clients non-restricted data transfer. This is considered any transfer of information in the form of text or graphic, directly readable by a web browser. My intention is to provide a large storage space to serve web documents, not an off-site storage area for electronic files. All web pages (HTML) must be 'linked' with files (.GIF, .JPEG, etc.) that are stored on my servers. Web sites that are found to contain either/or no HTML documents or a large number of unlinked files are subject to warning, suspension or cancellation at the discretion of The WebHelper's administration.

As a note, over 85% of my clients never exceed even 2000 megs of total FTP and web page transfer combined, so you can be assured that my bandwidth is not choked by numerous 'load-heavy' sites. To further protect the integrity of my service, any individual site consistently using 10% or more of the system's resources may be issued a warning or have its account deactivated.


Resources are defined as bandwidth and/or processor utilization. The WebHelper may implement the following policy to its sole discretion:

When a website is found to be monopolizing the resources available, The WebHelper reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of my servers.


All accounts are set up on a prepay basis. Although The WebHelper reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year, quarter or month following the date the account was established. Customers WILL automatically be invoiced again approximately one month in advance of the end of their prepay period.

Any account not paid in full by the end of their prepay period will be assessed a late payment fee of $10. If not paid by two weeks after the end of their prepay period will have their account closed. To reinstate their account will require a prepayment including all past due and new period hosting fees, late payment fees and a new account setup fee will be assessed.

In situations where the card number on file is declined The WebHelper will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, The WebHelper reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via e-mail shortly after the online purchase has been made. At this point the customer's card will be charged automatically.

All payment is only accepted in US dollars.


In order to streamline my accounting procedures and keep costs down The WebHelper accepts most major credit cards, personal checks (service will pend check clearance), and money orders.


Each of The WebHelper's web hosting plans carries a 30 day money back guarantee. If you are not completely satisfied with my services within the first 30 days of your hosting period, you will be given a full refund of the amount EXCLUDING setup fees. No refund is available after the 30th day. I must be notified, by the 30th day following activation.

The WebHelper reserves the right to cancel the service at any time. Customer refund requests are to be sent to The WebHelper and will only be processed after the 30 day money back period in the cases of service non-performance that might be caused by The WebHelper's side, Refund requests will be refused if it's requested for any cause that is out side of The WebHelper's control, For example:

- Domain transfer failure.
- Failure of any third party programs that's not supported by The WebHelper.
- Customers lack of experience in dealing with web basics and communication protocols.
- Any violations of my useage policies above.


Customer agrees that they shall defend, indemnify, save and hold The WebHelper harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against The WebHelper, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless The WebHelper against liabilities arising out of:

(1) any injury to person or property caused by any products sold or otherwise distributed in connection with The WebHelper's server.

(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.

(3) copyright infringement.

(4) any defective products sold to customer from The WebHelper's server.


The WebHelper will not be responsible for any damages your business may suffer, The WebHelper makes no warranties of any kind, expressed or implied for services I provide.

The WebHelper disclaims any warranter merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by The WebHelper and its employees.

The WebHelper reserves the right to revise the above mentioned policies at any time.
